Bankruptcy

If someone is declared bankrupt, a Trustee will be appointed to take control of their estate including their family home in order to turn their assets into cash to distribute among their creditors.

Corporate Insolvency

If a company is declared insolvent the Court has the power to wind it up and appoint a Liquidator who is charged with turning its assets into cash for distribution under the rules of the Corporations Act.

Usually the Creditor and the Liquidator will recover their costs involved in the liquidation process, followed by entitlements owed to the company's employees. The rest the available funds are distributed among unsecured creditors.
