There are three (3) ways your licence may be revoked in NSW:
· cancelled by the RMS (for example not paying your traffic fines);
· suspended by the Police or RMS (for example, loss of demerit points); or
· disqualified in Court by a Magistrate of Judge.
If you have been caught driving without a licence and have been charged with driving whilst disqualified, this offence is viewed by the Courts as the most serious as it is in breach of a court order.
Range of Penalties for Driving Whilst Disqualified:
First Offence:
· Fine of up to $3,300.00;
· An automatic minimum disqualification period of 12 months
· Possible imprisonment for a period of up to 18 months
Second or Subsequent Offence within Five Years:
· Fine of up to $5,500.00;
· An automatic minimum disqualification period of 2 years;
· Possible imprisonment for a period of up to two years.
