Power of Attorney and Appointment of Enduring Guardian

A Power of Attorney is a legal document allowing you appoint the person of your choice to manage your assets and financial affairs during the course of your lifetime.

If you are travelling overseas it may be practical for you to give your attorney access to your bank accounts to pay your bills, or to carry out the purchase or sale of a property.

Alternatively, it can be useful to have a Power of Attorney in circumstances where you become unwell and are no longer able to manage your financial affairs.

Making or “giving” a Power of Attorney does not mean that you will lose control over your financial affairs. It gives your attorney formal authority to manage your financial affairs per your instructions.

Your Power of Attorney can be revoked at any time, as long as you have the capacity to do so.

Appointment of an Enduring Guardian

Those with an eye on planning ahead for their financial or business affairs by making a Will or a Power of Attorney sometimes do not consider what will happen if they find themselves unable to make medical and lifestyle decisions, due to an accident or an illness.

An Enduring Guardian is someone you appoint to make lifestyle, health and medical decisions on your behalf when you are not capable of doing this for yourself.

Your Enduring Guardian may make decisions such as where you live, what services are provided to you and what medical treatment you receive.
